Welcome to Kaynotomia.
These Terms of Service govern access to and use of kaynotomia.com and the purchase of products offered through the website.
The terms “Kaynotomia”, “we”, “us” and “our” refer to Kaynotomia S.L., trading as Kaynotomia. Kaynotomia operates this online store and website, including its information, content, features, tools, products and related services, collectively referred to as the “Services”.
Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.
These Terms of Service, together with our Privacy Policy, Refund Policy and any other policies referenced on the website, describe your rights and responsibilities when using the Services.
Please read these Terms carefully before using the website or placing an order.

If you do not agree with these Terms, you should not use the Services.
SECTION 1 - ACCESS AND ACCOUNT
You may use the Services only if you have the legal capacity to enter into a binding contract.
If you are under the age of legal majority in your country of residence, you may use the Services only with the authorization and supervision of a parent or legal guardian.
To browse the website, create an account or place an order, you may be required to provide information including your name, email address, billing details, payment information, telephone number and shipping address.
You agree that the information you provide will be accurate, complete and current and that you are legally authorized to provide and use that information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity performed through your account, except where such activity results from circumstances attributable to Kaynotomia or its service providers.
You must inform us promptly at s.l@kaynotomia.com if you believe that your account has been accessed or used without authorization.
You may not sell, transfer, assign or license your customer account to another person.
SECTION 2 - OUR PRODUCTS
We make every reasonable effort to display and describe our products accurately, including their colors, materials, measurements, components and main characteristics.
However, colors and appearance may vary slightly depending on the screen, device settings, lighting conditions and photographic representation.
Certain Kaynotomia products are manufactured using additive manufacturing and three-dimensional printing processes. These manufacturing methods may produce minor variations in texture, surface pattern, layer visibility, finish, dimensions or appearance between individual pieces.
Minor variations inherent to the manufacturing process that do not materially affect the product’s functionality, durability, safety or conformity with its description will not normally be considered defects.
Nothing in this section limits your mandatory legal rights where a product is defective, damaged, unsafe, incorrect or does not conform to its description or agreed specifications.
Product descriptions, availability, prices, components and collections may be updated or discontinued at any time. Such changes will not affect orders already accepted, except where required by law or expressly agreed with the customer.
Any measurements stated on the website may be subject to minor reasonable manufacturing tolerances unless exact measurements have been expressly agreed as part of a personalized order.
SECTION 3 - ORDERS
By placing an order, you are offering to purchase the selected products under these Terms.
Your order will be considered accepted when Kaynotomia sends you an order confirmation after payment has been successfully authorized or processed.
Please review your order carefully before submitting it, including the product model, color, components, quantities, delivery address and any selected personalization options.
We may reject or cancel an order in circumstances including:

Product unavailability.

Payment failure or payment authorization issues.

Suspected fraud or unauthorized use of a payment method.

Legal or regulatory restrictions.

Incorrect or incomplete customer information.

An obvious pricing, technical or product information error.

An inability to deliver to the selected destination.
If we cancel an order after collecting payment, we will refund the amount paid using the original payment method without undue delay.
Personalized or made-to-order products may enter production shortly after an order is accepted. Once production has begun, requests to change or cancel the order may no longer be possible.
The statutory right of withdrawal does not apply to goods manufactured according to the customer’s specifications or goods that are clearly personalized.
This exception includes Kaynotomia products that are manufactured, configured or modified specifically according to personalization options selected by the customer.
The exclusion of the right of withdrawal for personalized products does not affect the customer’s rights where the product:

Is defective or damaged.

Is incorrect.
-
Does not match the agreed personalization.
-
Does not conform to its description or agreed specifications.

Is affected by another legally recognized lack of conformity.

Products purchased through the Store are intended for personal or household use unless Kaynotomia expressly agrees otherwise in writing.
Commercial resale, unauthorized reproduction or manufacture of Kaynotomia products or designs is not permitted without our prior written authorization.
SECTION 4 - PRICES AND BILLING
Prices are displayed in euros unless another currency is expressly shown.
Prices offered to consumers include applicable taxes, including value-added tax where legally required.
Shipping costs and any other additional charges applicable to the order will be displayed before the customer confirms the purchase.
For deliveries outside the European Union, the recipient may be required to pay customs duties, import taxes, local taxes or handling charges imposed by the destination country.
Unless expressly stated otherwise during checkout, customs duties, import taxes and destination-country charges are not included in the product price or shipping charge and are the responsibility of the recipient.
Prices, promotions and discounts may change without prior notice. Changes will not affect orders already accepted.
Promotional offers may be subject to separate conditions. If there is a conflict between the specific conditions of a promotion and these Terms, the specific promotional conditions will apply to that promotion.
You agree to provide complete, current and accurate billing, payment and contact information.
You confirm that you are legally authorized to use the payment method selected for the purchase.
If an obvious pricing or technical error is detected before an order is accepted, we may contact you to confirm whether you wish to proceed at the correct price.
If an obvious error is identified after payment and the order cannot legally or reasonably be fulfilled, we may cancel the affected order and refund the full amount paid.
Nothing in this section limits your mandatory consumer rights.
SECTION 5 - SHIPPING AND DELIVERY
Available shipping methods, estimated delivery periods and shipping costs will be displayed during checkout or in the relevant shipping information available on the website.
Delivery times are estimates and may vary depending on:

Whether the product is personalized or made to order.

Production requirements.

Circumstances outside our reasonable control.
Unless another delivery period has been expressly agreed, orders will be delivered without undue delay and no later than 30 calendar days after the contract is concluded.
If we become aware of a material delay, we will make reasonable efforts to inform you using the contact details provided with your order.
We are not responsible for delays caused solely by circumstances outside our reasonable control, such as severe weather, customs procedures, transport disruption, public authority actions, strikes, natural events or incorrect delivery information supplied by the customer.
This does not limit any mandatory rights available to the customer in the event of delayed or failed delivery.
The risk of loss or damage remains with Kaynotomia until the customer, or a third party designated by the customer other than the carrier, receives physical possession of the products.
If the customer independently appoints a carrier that was not offered by Kaynotomia, the risk transfers to the customer when the products are delivered to that carrier.
You are responsible for providing a complete and accurate delivery address.
Additional costs arising from an incorrect or incomplete address, refusal of delivery or failure to collect a shipment may be charged to the customer where legally permitted and where the circumstances are attributable to the customer.
SECTION 6 - INTELLECTUAL AND INDUSTRIAL PROPERTY
The Services and their contents are owned by or licensed to Kaynotomia and are protected by applicable Spanish, European Union and international intellectual property and industrial property laws.
Protected content includes, without limitation:

The Kaynotomia name and brand identity.

Logos, trademarks, slogans and graphic elements.

Product designs and three-dimensional forms.
-
CAD files, digital models and technical drawings.
-
Photographs, videos and audiovisual material.
-
Texts, descriptions and editorial content.

Packaging designs and presentation materials.
-
Website graphics, interfaces and layouts.
-
Product names, collection names and design concepts.
These Terms allow you to access and use the Services for personal and non-commercial purposes.
Without prior written authorization from Kaynotomia, you may not:

Copy, reproduce or manufacture our product designs.

Scan, reverse engineer or digitally reproduce our products.
-
Create molds, three-dimensional files or derivative designs based substantially on our products.
-
Distribute, sell or commercially exploit our digital or physical designs.
-
Remove or alter trademarks, labels or ownership notices.
-
Reproduce, republish or commercially use photographs, videos, texts or graphics from the website.

Present Kaynotomia products or content as your own work.
Purchasing a Kaynotomia product does not transfer intellectual or industrial property rights in its design.
Nothing in these Terms grants a license to use the intellectual property of Kaynotomia, Shopify or any third party except where expressly stated.
All rights not expressly granted are reserved.
The Shopify name, logo, product names and related trademarks belong to Shopify or its licensors.
Other trademarks appearing through the Services belong to their respective owners.
SECTION 7 - OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools, applications, payment systems or features operated by third parties.
We may not monitor or control all third-party tools and do not make representations about their independent services beyond what is required by applicable law.
Third-party tools may be provided on an “as available” basis and may be governed by their own terms and privacy policies.
Your use of an optional third-party tool is at your discretion, and you should review the applicable provider’s conditions before using it.
Nothing in this section excludes Kaynotomia’s responsibility where liability cannot legally be excluded or where the third-party service forms part of Kaynotomia’s contractual obligations to you.
New tools, features or resources made available through the Services may also be governed by these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may include links to websites, platforms or content operated by third parties.
Kaynotomia does not control all third-party websites and is not responsible for their independent content, security, availability, terms, privacy practices or commercial activities.
Accessing an external website is at your discretion. You should review the third party’s applicable terms and policies before completing a transaction or providing personal information.
Complaints concerning a product or service purchased directly from a third party should normally be directed to that third party.
This section does not affect your rights against Kaynotomia for products purchased directly through our Store or for services that Kaynotomia is legally responsible for providing.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Kaynotomia is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make in our Store are made directly with Kaynotomia.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Kaynotomia, including any injury, damage or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Kaynotomia, to the extent permitted by applicable law.

Because the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide, secure and improve its services.

You retain ownership of content that you create and submit.
By voluntarily submitting content for publication or promotional use, you grant Kaynotomia a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, adapt and distribute that content for the purposes of:

Nothing in this section allows Kaynotomia to unilaterally remove or reduce mandatory consumer rights after a valid contract has been concluded.

You may use the Services only for lawful purposes.
You must not use the Services:

SECTION 14 - AUTOMATED AGENTS
This section applies when a person uses or enables software that takes autonomous or semi-autonomous actions to access or interact with the Services.
An “Agent” means software or a service capable of acting on behalf of a person or entity without continuous direct human supervision.
An Agent may not access or interact with the Services where we have expressly requested that it stop or where access is blocked by technical measures.
Agents must:

Payment obligations remain unpaid.

Termination of website access does not affect:

Nothing in these Terms excludes or limits any mandatory legal guarantee, conformity right or remedy available to consumers.
Products sold by Kaynotomia must conform to the contract, product description, agreed specifications and reasonable quality and functionality expectations.
For products sold to consumers in Spain, Kaynotomia is legally responsible for a lack of conformity that exists at delivery and becomes apparent within three years from delivery, subject to the conditions and remedies established by applicable law.
Depending on the circumstances, legally available remedies may include repair, replacement, price reduction or termination of the contract.
Except for mandatory consumer rights and any express commitments made by Kaynotomia, we do not guarantee that access to the website will always be uninterrupted, completely secure or free from technical errors.
The website may occasionally be unavailable because of maintenance, updates, security incidents, technical failures or circumstances outside our reasonable control.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
This includes, where applicable, liability for:

Kaynotomia is not responsible for damage or loss caused solely by:

Use of a product contrary to its intended purpose.

Failure to follow care, maintenance or safety instructions.

Unauthorized alteration or repair.

Normal wear and tear.

Conduct attributable entirely to the customer or an unrelated third party.
These limitations do not affect statutory consumer rights or any remedy that cannot legally be limited.
SECTION 18 - RESPONSIBILITY FOR MISUSE
You are responsible for losses or damage directly caused by your unlawful, fraudulent or unauthorized use of the Services or by a material breach of these Terms, to the extent permitted by applicable law.
You must cooperate reasonably if your activity causes a legitimate third-party claim against Kaynotomia.
Nothing in this section requires a consumer to indemnify Kaynotomia beyond what is legally permitted or limits any mandatory consumer protection.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be applied to the fullest extent legally permitted.
Where necessary, the invalid or unenforceable part will be considered separated from the remaining Terms.
The remaining provisions will continue to be valid and enforceable.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
A failure or delay by Kaynotomia to exercise a right does not constitute a waiver of that right.
These Terms and the policies referenced within them form the agreement governing use of the Services and purchases through the Store.
They replace previous versions of these Terms regarding future use of the Services.
Nothing in this section excludes:

These Terms and contracts concluded through the Store are governed by Spanish law.
Where the customer is a consumer residing in another country, this choice of law does not deprive the customer of mandatory protections granted by the law that would apply in the absence of this choice, including protections available in their country of habitual residence where applicable.
Disputes will be submitted to the courts having jurisdiction under applicable consumer protection and civil procedure laws.
Where legally applicable, consumers may bring proceedings before the courts of their place of residence.
Nothing in this section restricts a consumer’s right to use an applicable alternative dispute resolution or consumer complaint mechanism.
